Lil Nas X appeared at a Los Angeles courthouse on Thursday for a hearing connected to a felony battery of a peace officer charge, the latest development in a legal case that began with his arrest in the summer of 2025. The Grammy-winning rapper, who rose to global prominence with Old Town Road and Montero (Call Me by Your Name), arrived with his attorney, who made an immediate and consequential request of the court.

His legal team asked the judge to grant a delay in proceedings, seeking time to file a motion that would allow the case to be transferred into a diversion program. Such programs, which vary in structure and requirements, typically result in charges being dismissed entirely if the defendant successfully completes a designated course of treatment or rehabilitation. The request signaled a clear strategy from the defense to pursue an outcome that avoids a criminal conviction altogether.

Lil Nas X and what led to the arrest

The incident at the center of the case occurred in August of last year in Los Angeles. Officers responded to a call involving the rapper, who was reportedly behaving erratically at the time. During the encounter, according to law enforcement accounts, Lil Nas X removed his clothing and moved aggressively toward an officer. He was subsequently taken to a hospital for medical evaluation amid concerns about a possible drug overdose.

He was charged with four felony counts connected to the incident. Following the arrest, Lil Nas X entered an inpatient treatment facility, a step his legal team may now be leaning on as part of the argument for diversion eligibility. He has pleaded not guilty to all charges.

Lil Nas X and the weight of what comes next

The legal stakes are significant. If the case proceeds to trial and results in a conviction, the rapper could face a sentence of up to five years in state prison. That prospect makes the diversion motion a critical piece of his defense, as a successful transfer to such a program would effectively allow him to sidestep the most severe consequences entirely.

Diversion programs in California have been used in a range of cases, particularly where mental health or substance use issues are identified as contributing factors. The circumstances surrounding Lil Nas X’s arrest, including the hospital evaluation and subsequent inpatient stay, could support his attorney’s argument that the case is an appropriate candidate for that kind of alternative resolution.

The judge had not yet ruled on the request for a delay as of Thursday’s hearing. The next steps in the case will depend on how the court responds to the forthcoming motion and whether prosecutors agree that a diversion pathway is appropriate given the nature of the charges.
