James Pearce Jr. got a small break but the case is far from over

Prosecutors dropped the aggravated battery charge against the Atlanta Falcons rookie, but stalking, fleeing police, and other serious counts remain on the table.

Atlanta Falcons defensive end James Pearce Jr. will no longer face a charge of aggravated battery on a law enforcement officer stemming from an alleged domestic dispute with WNBA player Rickea Jackson. Prosecutors made the decision to drop that specific count after concluding that the available evidence was not strong enough to meet the burden of proof required for a conviction beyond a reasonable doubt. A spokesperson for the district attorney’s office confirmed the reasoning behind the decision.

For Pearce, 22, the dropped charge carries real significance on paper. A conviction on aggravated battery against a law enforcement officer in Florida carries a potential sentence of up to five years in prison. Having that count removed from the case is a meaningful development in isolation.

What Pearce still faces

The rest of the case, however, remains intact and the charges still pending are serious. Prosecutors have filed counts of stalking, fleeing and eluding police, resisting an officer with violence, and aggravated battery with a deadly weapon. Each of those charges carries its own potential penalties, and taken together they represent a substantial legal exposure for the first-year NFL player.

Pearce has not made any public statement about the case through his attorney, and his legal team had not responded to requests for comment as of the time this article was published.

What happened in Florida

The incident that produced these charges took place in Florida last month. According to court documents, Pearce became involved in an alleged domestic dispute with Jackson, who plays for the Los Angeles Sparks in the WNBA. The documents state that he pursued her in his vehicle as she attempted to leave the situation. She drove toward a police department, and Pearce allegedly drove his Lamborghini into her car while she was en route to the station.

Once Jackson arrived at the police department, Pearce allegedly fled the scene. Officers pursued him, took him into custody, and he was booked into jail. The sequence of events described in the documents formed the basis for the multiple charges prosecutors ultimately filed.

Jackson’s restraining order and her own account

In the days following the arrest, Jackson took additional legal steps to protect herself. She filed a restraining order against Pearce, whom she identified as her former boyfriend. The filing described her emotional state in terms that left little ambiguity. Jackson wrote in the documents that she feared for her life, a statement that added weight to the seriousness of the allegations and her account of events.

The restraining order was a separate legal action from the criminal case but reinforced the picture prosecutors have been building. Jackson’s written account of her fear and the circumstances she described are part of the public record and are likely to play a role in how the remaining charges are argued going forward.

Pearce’s position as an NFL rookie

Pearce was selected by the Atlanta Falcons in the first round of the 2024 NFL Draft out of Tennessee, where he established himself as one of the more disruptive pass rushers in college football. His transition to the professional level brought considerable expectations, and the events of the past month have put his off-field situation at the center of attention surrounding the franchise.

The Falcons have not issued a public statement addressing the charges or the dropped count. The NFL has not announced whether it intends to open a separate investigation under the league’s personal conduct policy, though cases of this nature typically draw scrutiny from the league office.

The criminal case against Pearce continues with four active charges still pending. How prosecutors proceed and whether Pearce’s legal team pursues any additional motions to dismiss will shape what comes next in a case that is still moving through the courts.
