Dillon Brooks DUI charge and league discipline

Phoenix Suns forward Dillon Brooks has been charged with driving under the influence following an arrest in Scottsdale, Arizona, in March, according to court records. He is scheduled to be arraigned on Oct. 28.

What is the charge?

A Class 1 misdemeanor, the most serious misdemeanor classification in Arizona. The arrest took place during a traffic stop at around 1 a.m. on March 6. No plea has been entered and the arraignment is where that happens.

Has anything been decided?

No. A charge is an accusation by prosecutors, not a finding by a court. The Dillon Brooks DUI charge will be contested or resolved through the normal process, and nothing about the filing establishes that an offence occurred.

Why the gap between arrest and charge?

Seven months is long but not unusual. Impaired driving cases frequently wait on laboratory analysis of blood samples, and backlogs at state crime labs routinely delay filing decisions by months. The interval does not indicate anything about the strength of a case in either direction.

What has the team said?

Little, and deliberately. A Suns communications executive said the charge stems from the March incident, that the team has addressed the matter with the player and that it has no further comment. Representatives for the player did not respond to requests for comment.

Is there another case?

Yes, a separate one. A misdemeanor reckless driving and speeding matter from January is also in the Scottsdale court system, with a trial readiness conference set for Nov. 9. That is a distinct proceeding and also unresolved.

Could the league act?

Possibly, and not necessarily soon. The NBA’s conduct policy allows discipline for off court matters, but leagues typically wait for legal proceedings to conclude before deciding, particularly where no conviction exists. Nothing has been announced.

Where does this leave his season?

Unaffected for now. He is entering a tenth NBA season after agreeing to a three year extension worth $73 million running through 2029 to 30, following a career best 20.2 points per game last season. Arraignment and the conference in the other matter both fall during the season, which means court dates will intersect with the schedule.

What is the career context?

Ten seasons across Memphis, Houston and Phoenix, with career averages of 14.8 points, 3.3 rebounds and 2.0 assists. Last season was comfortably his most productive, which is what produced the extension. The Dillon Brooks DUI charge arrives at the start of that contract rather than at the end of his time with the team.

What happens next?

Arraignment on Oct. 28 in the first matter and the readiness conference on Nov. 9 in the second. Both are procedural steps rather than resolutions, and neither will settle either case.
